Petition for Pregnant Prisoners Rehearing Granted

August 28, 2008

This week the 8th Circuit Court of Appeals did something unusual. It granted the petition for rehearing of Shawanna Nelson's case challenging the routine shackling of pregnant prisoners during labor and delivery. According to National Advocates for Pregnant Women, this is extremely rare: "In a typical year, less than 100 cases are granted such review in the entire federal system. We believe that this rare grant of en banc review was given because of the support of the amicus brief that we all filed that reflected an overwhelming condemnation of shackling from varied constituents - from prison reform activists to advocates for women's health."

NOW is proud to be part of this effort. Read the brief (PDF).
